uranium sales to India and immigration minister Chris Bowen's proposal to increase the
refugee intake in return for a platform supporting offshore processing of asylum seekers.
There will also be discussion on party reform to address falling membership.
Ms Gillard said the party must set a recruiting challenge of 8000 new members in 2012.

Hurricane Electric, an IPv6-native Internet backbone and collocation provider, has announced that its IPv6 Evangelist, Owen DeLong, will lead a new professional services division dedicated to assisting enterprises with their transition to IPv6.
Hurricane Electric said that the new division will consult with organizations of all sizes, ensuring that their networking infrastructure is ready for the transition.
On Feb. 3rd, the Internet Assigned Numbers Authority (IANA) distributed the last 5 blocks of IPv4 addresses to the Regional Internet Registries (RIRs). The Company reported that it is likely that the RIRs will distribute these addresses to ISPs and other organizations by around September of 2011. After this happens, there will be no IPv4 addresses left - the supply will be exhausted.
Hurricane Electric noted that enterprises that delay the transition from IPv4 to IPv6 will eventually experience connectivity- related issues and associated financial losses. For example, ecommerce sites that fail to make the transition run the risk of revenue losses if consumers cannot connect to their site.
Despite the effort required to transition to IPv6, the Company said that IPv6 has tremendous long-term benefits and the ROI is strong now. According to a US Commerce Department study, ongoing benefits to the global economy of $10 billion/year will result from IPv6 adoption.

A car has been swept off the road by floodwaters east of Adelaide .. trapping two people inside.
South Australian police say the car left the road about six kilometres from Mannum
.. and emergency services have been sent to help the occupants.
There are also reports of a house flooded in the area .. while flooding is also causing
problems in the towns of Willaston and Sandy Creek .. north of Adelaide and at Mt Torrens
in the Adelaide Hills.
About a dozen houses lost their roofs in the storms .. and there have also been widespread
blackouts and crop damage.
A severe weather warning has been issued for most parts of the state .. particularly
the Adelaide Hills and areas to the east and south of the city.

SYDNEY, Dec 17 AAP - Former NSW crime fighter Mark Standen has suffered significant
mental health damage while in custody awaiting his drugs trial, a judge has been told.
Summarising the 51-year-old's bail application on Thursday, his barrister Mark Ierace,
SC, said the damage flowed from his onerous segregation conditions.
He stressed the need for Standen to properly prepare for his trial, suggesting strict
bail conditions which would mean Standen was "under house arrest".
On Wednesday in the NSW Supreme Court, Justice Bruce James vacated the February 1 date
for Standen's trial on charges of plotting to import a commercial quantity of a chemical
precursor of the illicit drug ice.
Standen, who was a senior investigator with the NSW Crime Commission, has been on remand
since June 2008.
He denies the charges and is now expected to be tried around the middle of next year.
The judge was told Standen was virtually in isolation but was able to play Scrabble
with former Federal Court judge Marcus Einfeld, who is serving time in the same jail for
lying over a speeding ticket.
On Thursday, Justice James - who sentenced Einfeld - was shown newspaper reports referring
to the Scrabble contact and pointing out similarities in the men's lives.
"Another thing they share is me," the judge commented.
In opposing bail, crown prosecutor Tim Game, SC, submitted that Standen presented "as
a major flight risk", noting he faced very serious charges.
He said Standen had "poor" motivation to stay, citing the loss of his marriage, his
relationship and his house.
His brother, Grant Standen, gave evidence that he was willing to put up the family's
Sydney house as surety, and that Mark Standen could live there if he was granted bail.
He said that he would notify the authorities if he became aware his brother intended
to abscond, adding that he would not jeopardise the house.
Justice James is expected to give his decision later on Thursday.

New figures show more than 120 New South Wales ambulance officers were assaulted in
the past 12 months while on the job.
The state's ambulance service says that's a 60 per increase over last year.
While Health Minister JOHN DELLA BOSCA won't speculate whether the development is linked
to the use of the drug ice .. he says the changing pattern of drug use and alcohol-fuelled
violence add risk to paramedics.
In the latest incident a paramedic was allegedly assaulted in the Wollongong suburb
of Warilla while treating a man who needed a bandage and stitches early today.

A remote north Queensland town is racing to secure a freshwater supply as widespread
flooding and crocodiles prevent the repair of a pipeline.
Karumba's water pipeline from Normanton has burst .. and fresh water will run out in
as little as three days.
The pipeline is two metres under water and can't be fixed until the floodwaters in
the Gulf of Carpentaria drop .. which is not likely until next month.
So .. a portable water treatment plant is being flown in .. which Carpentaria Shire
Council chief executive MARK KELLEHER says is scheduled to be installed over the weekend.
Meanwhile .. the Thomson River at Longreach is expected to rise slowly and peak at
about 4.6 metres today .. after recent rains.

BRISBANE, Aug 26 AAP - A north Queensland school principal is under pressure to perform
a policy backflip after he banned students from doing cartwheels and handstands in the
playground.
Belgian Gardens State School in Townsville has banned all gymnastics activities during
breaks, claiming it is protecting students from injury.
Education Minister Rod Welford today called for a review of the decision made by the principal.
Mother Kylie Buschgens told the Townsville Bulletin she was dumbfounded when her daughter
Cali, 10, was told she could no longer do cartwheels, even on the grass.
When her daughter first said she was in trouble for doing cartwheels, Ms Buschgens
presumed the moves were being done on concrete.
But she said the school had made an announcement at assembly that the activity was banned.
Cali said a friend had also been caught and punished for doing cartwheels.
Cali said she and her friends now "sit around and do nothing" during breaks because
they don't like other sports.
Education Queensland defended the ban on unsupervised gymnastic activities, and denied
the measure was motivated by a fear of litigation for any injuries.
A spokeswoman for Education Minister Rod Welford told AAP the principal was "reviewing
the decision and the minister has given his support for that".
"Obviously there's been quite a bit of community backlash against the decision so the
minister just asked for them to have another look and see if that's what they really want
to do," the spokeswoman said.
"It was just one principal's decision and there's no state-wide directive that cartwheels
are banned in all Queensland schools or anything like that."

BRISBANE, April 21 AAP - One of Australia's largest coal terminals has been approved
for central Queensland.
Federal Environment Minister Peter Garrett has signed off on the environmental impact
study for Wiggins Island Coal Terminal, an expansion of Gladstone port's coal terminal.
It follows the Queensland government's approval earlier this year.
Premier Anna Bligh said the terminal would open in 2012-13, employing 500 people in
construction and 130 in operation.
Ms Bligh said the first $1.3 billion stage of the expansion would boost Gladstone's
coal exports by a third, or 25 million tonnes, and generate up to $1.8 billion annually.
"When I was in India and China during my recent overseas trade mission, one of the
constant recurring themes was the rapidly escalating demand out of those two growing economies
for Queensland coal," Ms Bligh told reporters in Brisbane today.
"Critical to that is getting the coal out of the ports."
Infrastructure Minister Paul Lucas said the expansion would take Gladstone's port to
its limit, handling 75 million tonnes of coal each year.
"I think it's unlikely that there will be further coal port development there at Gladstone,"
he said.
A $500 million rail upgrade - the Moura Link-Aldoga Rail Project - will be carried
out to take coal to the new terminal.

Professor FIONA STANLEY's broken down in tears .. speaking of child mortality rates
at an inquest into the link between substance abuse and Aboriginal suicides in Perth today.
She says successive Australian governments have failed to implement the recommendations
of a number of studies .. resulting in a range of worsening problems in Aboriginal communities.
Professor STANLEY's told the WA Coroner's Court the impact of the Stolen Generation
is one of the main causes of issues surrounding alcohol abuse in Aboriginal communities.
And she says while FAS rates in Aboriginal communities are very high .. data on the
syndrome is limited.
Professor STANLEY broke down as she revealed nine in every one thousand indigenous
children dies between 13 and 16 in indigenous communities .. from accident .. injury or
infection.
She says empowering Aboriginal communities by supporting their strategies and employing
Aboriginal people in Aboriginal run services is key to change.

A key government consultancy firm has found opposition leader KEVIN RUDD is the preferred
prime minister as voters see JOHN HOWARD as old and dishonest.
News Limited newspapers have reported crashing voter support is a serious worry for
the government.
The leaked dossier entitled 'Federal State of Play - Oz Track 33' came from Liberal
party pollsters MARK TEXTOR and former Liberal federal director LYNTON CROSBY.
The Crosby/Textor team are the prime minister's principal strategy and consultancy
team .. having worked with the party since its first election win in 1996.
The leaked report reveals that the last federal budget failed to garner voter support
despite $31.5 billion tax cuts.
The poll also found key swinging voters are disillusioned with the PM and not too
interested in Treasurer Peter costello taking the party's reins.
"There is significant disillusionment with Liberals on the issue of broken promises
and dishonesty," the report found.
Voters have confidence in Mr Rudd because he was seen as articulate and intelligent
with a broader range of life experience.
Mr Rudd's was also preferred to pollsters due to his age of 50 years as opposed to
Mr Howard's 68 years.
The research found Mr Rudd is perceived as far more "likeable," "genuine" and "compassionate".

CANBERRA, Feb 12 AAP - The controversial $2 million security bollards at Parliament
House in Canberra need a $32,000 service to keep them operating, a committee has been
told.
The 182 bollards were installed last year to stop potential suicide bombers from reaching
the doors of parliament.
But they were plagued by more than 100 malfunctions in the first 10 months, with bollards
rising without warning, trapping cars and in one case impaling a tractor.
Since they were recommissioned late last year, there has only been one incident, a
Senate estimates committee was told today.
"Since then the malfunctions seem to have been reduced," Department of Parliamentary
Services (DPS) head Hilary Penfold told the committee.
"There haven't been all that many in the last two or three months but on the other
hand we have to recognise that it hasn't been very busy most of that period.
"So we still haven't seen how they're going to perform under pressure as a result of
that recommissioning and new maintenance."
The bollards need routine maintenance every 12 months which is expected to cost taxpayers
$32,000, departmental officer Rodney Bray told the hearing.
"In order to keep the bollards properly performing, we've agreed to pay this one-off
major maintenance activity which now needs to be done while the negotiations for the ongoing
contract are resolved," Mr Bray said.
"So we pay the $32,000 so the necessary maintenance work is carried out that needs
to be done now, and in the intervening few weeks or couple of months, DPS will finalise
the ongoing contract," Mr Bray said.

Premier STEVE BRACKS says security on Melbourne's underground rail system is adequate
.. despite an incident early today in which a ticket evader carrying a backpack ran into
one of the tunnels.
The man jumped from the platform at Melbourne Central railway station about 7 am (AEST)
.. entering a tunnel leading to Flagstaff station .. less than a kilometre away.
Trains were halted for a short time in the tunnel .. which serves the Epping and Hurstbridge
rail lines .. as inspectors and police searched for the man.
But he was later seen leaving the tunnel at Flagstaff station .. where he again evaded security.
The premier says security on the underground rail system is adequate .. and passengers
weren't in danger.
The city loop's security arrangements underwent an overhaul last year in the wake of
the London underground bombings .. and as part of preparations for the Melbourne Commonwealth
Games in March.
Victoria Police say the man who sparked the security scare was on the run from ticket inspectors.

CANBERRA, April 19 AAP - The federal government has warned Australians against travelling
to the strife-torn Solomon Island.
Political unrest broke out in the capital Honiara yesterday after MPs chose Snyder
Rini as the new prime minister in a general election dominated by allegations of corruption.
The violence spread overnight and degenerated into a spree of looting and arson in
parts of Honiara, mostly in Chinatown at the eastern end of the city.
In its latest travel advisory issued this afternoon, the Department of Foreign Affairs
and Trade warned Australians against travelling to the troubled nation.
"We advise you to reconsider your need to travel to Solomon Islands at this time because
of continuing significant civil unrest in Honiara following the announcement on 18 April
of the results of the recent prime ministerial elections," the advisory reads.
"You should avoid unnecessary travel and crowds in and around the city centre, eastern
Honiara and Chinatown areas in particular.
"If you decide to travel to Solomon Islands, you should exercise extreme caution. Monitor
the media for information about possible new safety or security risks."
The Australian government has also called on citizens in, or about to enter, the Solomon
Islands to register their contact and travel details in case of an emergency.

CANBERRA, Dec 14 AAP - Prime Minister John Howard today played down the prospect of
a quick Telstra sale and hinted the government might relax the company's foreign ownership
restrictions.
Mr Howard said that while the government had announced plans to carry out a scoping
study examining all aspects of Telstra's full privatisation, the $30 billion sale would
not necessarily take place in the next three years.
The government hopes to have the scoping study wrapped up by mid next year before legislation
paving the way for the sale is introduced to parliament.
Asked on radio if the start of the study meant Telstra's sale during the government's
third term was a forgone conclusion, Mr Howard replied: "No."
"But if we are to keep alive the option of selling Telstra during this term of government
we must do the scoping study now, otherwise time will be against us," he told ABC radio.
Communications Minister Helen Coonan has previously said the Telstra sale could go
ahead in 2006 if the necessary legislation passes parliament next year.
Mr Howard said the government was seeking advice on whether its remaining 51.8 per
cent shareholding in Telstra would be sold in one lot or in separate parts.
The government has pledged that Telstra will only be fully privatised if its services
in the bush are adequate and legislation passes parliament.
It also wants a good price for its shares.
One way of helping Telstra's share price, which remains below $5.00, could be relaxing
the foreign ownership cap on the company.
Mr Howard said the government had not given much thought to the cap, which limits foreign
companies from collectively owning more than 35 per cent of Telstra.
However, he acknowledged Telstra's share price could improve if foreign companies were
allowed to own a greater slice of it.
"These things are always difficult," Mr Howard said.
"On the one hand everybody likes everything to be fully Australian-owned. We all emotionally
would like that.
"On the other hand, we can sometimes get more investment and a better price and greater
activity if we allow greater levels of foreign investment."
As the Telstra sale moves a step closer with the start of the scoping study, some members
of the Nationals remain concerned about whether Telstra's services in the bush are good
enough.
Deputy Prime Minister John Anderson today said while mechanisms were being put in place
to improve services, some areas were still having difficulties.
But he denied suggestions the Queensland Nationals had drawn up a wishlist of projects
they wanted the government to fund using proceeds from Telstra's sale.
"No they're not, not in any formal sense," he said.
"We'll welcome any contribution to the debate (but) in the end it's important that
we walk through these issues in due course and I'm not going to get into a business of
some bidding war ... now."
Meanwhile, the competition watchdog has stepped up its calls for Telstra to split its
core businesses before the telco's full privatisation.
Australian Competition and Consumer Commission (ACCC) chairman Graeme Samuel said Telstra
should separate its wholesale and retail businesses to help improve competition in the
telecommunications industry.
However, he did not believe that if such a split occurred before Telstra's privatisation
that the government would not get a good price for its Telstra shareholding.

The acquisition brings a number of operational, financial and technical benefits to Golden Telecom that are evident in our fourth quarter results.
In Nizhny Novgorod we merged our existing operations to create the largest independent operator in Russia's third largest city. Our activity in Nizhny Novgorod over the past two years is a prime example of the implementation of our regional expansion strategy. We will continue to adopt the successful business model that we developed in Moscow and transplant that model, with appropriate modifications, in the Russian regions.
Elsewhere, in 2002 we acquired the remaining 31% stake in Golden Telecom Ukraine. This acquisition contributed to a more constructive and productive relationship with Ukrtelecom, the state owned monopoly carrier, which should allow us to deploy the infrastructure necessary for the growth of that business. Finally, our restructuring efforts in 2002 are creating a more focused and customer driven company. We look forward to the challenges of 2003, being stronger than ever before."

More Fourth Quarter 2002 Results:
Consolidated revenues were $76.8 million - up 109% compared to the fourth quarter of 2001, and up 66% compared to the third quarter of this year. Pro-forma combined revenues were $76.7 million - up 17% compared to the fourth quarter of 2001 and up approximately 1% compared to the third quarter of this year.
Competitive Local Exchange Carrier (CLEC) business line consolidated revenues were $49.7 million - up 360% compared to the fourth quarter of 2001, and up 152% compared to the previous quarter. The impact of consolidating Sovintel's results in the fourth quarter was $36.8 million. The consolidation of Sovintel affects only the CLEC line of business. On a pro-forma combined basis, CLEC revenues were $49.7 million - up 24% compared to the fourth quarter of 2001 and flat compared to the third quarter this year.
Data and Internet business line consolidated revenues were $21.5 million - up 16% compared to the fourth quarter of 2001, and up 12% compared to the previous quarter. The growth was driven primarily by our Consumer Internet service. Dedicated Internet access revenue was adversely affected by the bankruptcy of KPNQwest during 2002.
Internet subscribers increased to 242,155 - up 30% from 185,628 subscribers at the end of the fourth quarter of 2001, and up 26% compared to the previous quarter. Subscriber growth was driven predominately by subscribers located in major population centers outside of Moscow and St. Petersburg.
Consolidated Long Distance business line revenues were $5.2 million - up 24% compared to the fourth quarter of 2001 and up 13% compared to the previous quarter due to increased volume of traffic, which more than offset tariff reductions.
Consolidated Mobile Services revenues were $3.1 million - down 11% compared with the fourth quarter of 2001 and down 6% compared to the previous quarter due to a reduction in the number of cellular subscribers.
Consolidated EBITDA(1) was $24.7 million - up 147% from $10.0 million in the fourth quarter of 2001, and up 76% compared to the previous quarter. The impact of consolidating Sovintel's results in the fourth quarter on EBITDA(1) was $14.7 million. Consolidated EBITDA(1), as a percentage of consolidated revenue was 32%, up from 27% in the fourth quarter of 2001, and up from 30% in the previous quarter. The increase is largely the result of our continuing effort to control costs and a more effective use of available network capacity.
Consolidated income tax for the fourth quarter was $0.8 million. During the quarter, income tax expense was reduced by $3.6 million due to the recognition of carry-forward tax losses at a Russian and Ukranian subsidiary level. The impact of consolidating Sovintel's results for the quarter on income tax expense was $3.2 million.
Net income for the fourth quarter was $13.0 million compared to a net loss of $29.7 million in the fourth quarter of 2001 and compared to net income of $7.8 million reported in the previous quarter. The improvement was due in part to 1) the consolidation of Sovintel's results from mid-September 2002; 2) the effects of new US accounting standards for goodwill and intangible assets that became effective and were adopted by the company from January 1, 2002 and 3) the impairment charge in the fourth quarter of 2001, and the related reduction in depreciation and amortization from that date. Net income for 2002 was $29.8 million compared to a net loss of $39.0 million in 2001.
Net income per common share on a fully diluted basis in the fourth quarter of 2002 was $0.48 compared to a net loss of $1.33 for the fourth quarter of 2001. The diluted weighted average number of shares outstanding in the fourth quarter of 2002 was 27.2 million compared to 22.4 million in the fourth quarter of 2001. The Company retired approximately 2.3 million shares of common stock, previously held as treasury stock, in the fourth quarter of 2002. As of December 31, 2002 the Company had outstanding 27.0 million shares of common stock.
Golden Telecom closed the fourth quarter of 2002 with a total of $59.6 million in consolidated cash. On September 25, 2002 a subsidiary of Golden Telecom entered into a secured $30.0 million credit facility with ZAO Citibank in Moscow. The subsidiary drew upon the facility in the fourth quarter as part of the funds used to retire the $46 million promissory note issued to OAO Rostelecom in connection with the Sovintel acquisition. On March 4, 2003, Standard and Poor's Ratings Services assigned its "BB-" long-term credit rating to Golden Telecom.

Medtronic=s warning of earnings shortfall prompts fall in stock price.
Following Medtronic Inc=s forecast that revenues and earnings per share for its first quarter would be below company expectations and analysts' published estimates, the company=s stock price fell by about 10% at the beginning of August.
The US medical device manufacturer said constant-currency revenues grew 4% to about US$653 million in the quarter ended July 31 1998. Accordingly, diluted earnings per share are expected to be 32 cents, compared with 31cents for the first quarter last year, and 2 cents below the Wall Street consensus.
The company was planning to announce full first-quarter financial results on August 18.
Press reports suggest that Medtronic is coming under fire from its competitor Guidant Corp in the fast-growing heart defibrillator market. According to the Wall Street Journal, Medtronic and Guidant have been neck and neck= in both the US and worldwide markets.
Guidant has a dual-chamber defibrillator device, called the Ventak AV II, already on the US market. But Medtronic has such a device on sale only overseas.
The Medtronic device, called the GemJ DR, is not yet approved by the US Food and Drug Administration (FDA), but the company anticipates regulatory clearance of its Gem DR/SR defibrillators in its second quarter this autumn. AMedtronic expects significant revenue growth as new products, now winning rapid acceptance in international markets, are launched in the United States,@ said William George, Chairman and Chief Executive Officer. Along with the Gem DR defibrillator system, he also cited the advanced Kappa 7 700 pacemaker system, both of which are now gaining market share internationally.
AIt was a challenging quarter,@ George said, Abut we believe Medtronic is positioned for its full fiscal year to substantially surpass the $1.27 per share (before one-time charges) the company earned last year.@

Citi's Mobile Reboot; Bringing in a retail e-commerce guru is already paying dividends for Citi's mobile services.(Fast Forward)

obile and online services are at the center of Citigroup CEO Vikram Pandit's declared retail strategy, but for years its initiatives on those fronts had been choppy at best. Now, in an effort to improve the quality, and volume, of its customer interactions through electronic channels, Citi is turning to a noted e-commerce pioneer.
In October, Citi hired Tracey Weber as its managing director of Internet and mobile for North America consumer banking. Weber, formerly Travelocity North America president and chief operating officer, had spent the better part of a decade at that company, where she pushed through numerous customer service innovations, such as providing ticket buyers with pre-purchase seat availability information.
Weber says her focus at Travelocity had been figuring out customer's needs, not so much from a transaction perspective, but more as they related to the design and feel of Web services. "I think my hiring is a sign that Citi very much wants to put design and customer experience at the forefront of everything that we do," says Weber, who also had a brief stint at Barnes & Noble in 2010.
She takes charge of a business that has been very active. In the last 18 months, Citi has unveiled text banking, enhanced its mobile browsers, introduced iPhone and Android apps, and launched its online Mobile Showcase to instruct customers on using mobile banking services.
"We still think that there is a lot of education that has to happen with consumers about how to use mobile for everyday banking; so making it visual for them we thought was a good investment," Weber says. An early sign of progress she cites is 60 percent growth in mobile usage by Citi's credit card customers last year.
Citi also ramped up its social networking chops by recruiting Frank Eliason-who pioneered Twitter-based customer service at cable giant Comcast-to lead a similar effort via @AskCiti.
Ron Shevlin, senior analyst at Aite Group, says the hiring of Weber and Eliason was a savvy move for Citi to gain fresh ideas. Citi's mobile and consumer banking leadership had been in a state of flux, with former online and mobile leader Liza Landsman leaving her post last August after less than a year. Citi's former North American consumer banking chief Terri Dial also was replaced in January 2010 when Latin America head Manuel Medina-Mora's role was expanded to oversee consumer banking in all the Americas.
"People who spend 20 years in banking know the industry very well but often tend to be narrowly focused in terms of understanding how people want to be engaged with new channels," says Shevlin. "The banking world looks at things very much from a transaction perspective."
Weber's hiring isn't the first of Citi's unorthodox mobile moves. In 2006 it became an early adopter of a mobile peer-to-peer payment platform (Obopay), and in 2008 it backed a joint venture with South Korean carrier SK Telecom to market a mobile payments platform to financial firms, payments networks and even wireless carriers. More recently, Citi reportedly began working with Google and MasterCard on a contactless payments platform.
As for future plans, Weber says that Citi is exploring adding P2P payments to its mobile app and is looking at ways to capitalize on the popularity ofthe iPad.

Abstract
Digital forensics experts are called on to collect and analyze digital information from electronic devices such as computer hard drives and cell phones. Electronic evidence is used in a wide variety of cases, ranging from corporate espionage to employee separation or divorce. Recent changes to the Federal Rules of Civil Procedure have legitimized the use of digital evidence in court, making this new field of forensics more relevant than ever.

An increasing number of business and legal investigations include evidence extracted from digital devices such as computer hard drives, PDAs, and cell phones. When it becomes apparent that digital information must be used in the course of an investigation or discovery process, digital forensics experts must be employed to carefully gather pertinent evidence.
Digital forensics professionals are responsible for the collection, analysis, and investigation of electronic evidence from digital devices. The gathered "snapshot" of information must be collected in a detailed, methodical, and scientific manner, as any or all evidence can be used in discovery, in depositions, or in trial.
Historically, paper documents have been the mainstay of evidence production in the court system. However, a standard computer hard drive contains enough easily readable information to fill hundreds of thousands of sheets of paper, making the court's reliance on paper imprudent. Digital documents in their native formats also contain information that their paper counterparts do not, such as user access dates and editing information. This type of information, called "metadata," can offer valuable clues regarding user interaction with documents and files. For example, Microsoft Word can capture important information such as edits made using the track changes feature of the program. The production of digital documents during court proceedings is important to ensure all necessary information has been preserved.
Case Study
John Smith has a wife of 10 years and two young children and lives in the suburbs. He likes golf and the occasional fishing trip and owns his own business. And he has been cheating on his wife with an Internet girlfriend for 2 years.
They have chatted on an instant messenger at work, emailed pictures and jokes, and even planned weekend getaways to Louisiana. When she did not show up for the first trip, Smith was worried. But when she did not arrive at the prearranged hotel for the next two trips, he became suspicious. He could not imagine why someone who wrote such heartfelt emails would treat him with such disregard.
Tired of waiting for an answer, Smith hired a private investigator to identify his mystery woman. Internet searches were inconclusive, and the service provider would not give the woman's personal information without the threat of legal action and a subpoena. After striking out on all of the usual investigative avenues, the investigator told Smith that he was not finding any significant information.

But fortunately for Smith, the private investigator had close connections with a digital forensics company that helped him identify Smith's girlfriend through email communications.
The forensics investigators began by targeting the general area where the girlfriend was sending emails by investigating the address-like information embedded in the email. All emails contain "headers" with destination and return addresses, much like envelopes. Headers also include addresses from each routing point that the email passes through on the Internet, showing the path taken to reach a destination.
Ironically, the email headers led the forensics experts to a computer in the same city as Smith--something that came as quite a surprise to him. He could not believe that he had scheduled trips out of state and spent hours chatting with someone that might be living on the same street.
Like Smith, the private investigator found the situation suspicious. Why would someone so close and invested in a relationship want to hide her location?
The forensics experts investigated all of Smith's emails and compared all email headers. Suspicious that Smith might be 'dating' someone he already knew, the investigators looked to see if any emails sent from Smith's girlfriend matched an email sent from someone else in his mailbox.
Both the forensics experts and the private investigator were correct. After making a careful comparison and double-checking the results, the forensics experts found that the girlfriend's emails were being sent from the same address as Smith's home computer. They concluded that Smith had been cheating on his wife with his wife for more than 2 years.
Smith was understandably shocked! Although forensics cannot answer all the questions that would naturally follow such a revelation, it did catch a woman who believed she was anonymous on the Internet.
Common Forensics Investigations
Two surprisingly common misconceptions are that emails cannot be traced and that chat room participants cannot be found. As a result, people often do and say things online that they would not in a face-to-face conversation. The impersonal nature of email and instant messaging can lead to problems, both personal and professional.
The majority of forensics cases involve employee separation and discrimination issues. Most often, an employee exits a company with proprietary information and uses it to establish a competing business.
Some are brazen enough to email themselves client lists, engineering specifications, and account information. Others are more discreet, preferring to burn such information to a CD or download it to a flash drive. Fortunately, forensics experts can not only examine system files to determine whether a transfer has been made to external media, but also conduct thorough examinations for email attachments.
Forensics experts are often called to examine computers from employment lawsuits, such as discrimination, sexual harassment, and wrongful termination. In these cases, the investigated computer has often been used for several months since the employee's departure, presenting challenges to forensics examiners. This is particularly true if the key information has been deleted.
Deleted Information Is Not Gone
When information is deleted from a digital device, the file itself is not erased but, rather, the computer's reference point for the file is erased. It is much like removing a card from the library's card catalogue, but not taking the book off the shelf. The computer then marks the space containing the file as available. If a large amount of data is added to the drive, there is a chance that the "deleted" file can be overwritten. However, the use of very large hard drives in most current computers makes the chance of overwriting unlikely, and fragments of documents can often be found even a year after normal computer use.
Another recent forensics case involved a wrongful termination suit brought against a construction company by a former employee. He had been fired due to cost overruns on the company's biggest project. The employee's suit claimed his superior directed the project into overruns and blamed the results on other employees. The documents produced by his lawyers included emails sent to the superior, which cited warnings of overruns and suggestions to avoid them.
Forensics experts were asked to investigate the former employee's computer for evidence of these emails, which the superior claimed never to have received. Examination of the computer showed pieces of the email text within the hard drive's "unallocated space," the areas where deleted information is sent. Yet the text did not appear in the former employee's email folders.
The forensics company recommended a review of the company's email servers through which the emails would have passed if they had been sent. No evidence of the emails was found.
Later, evidence of a forgery was discovered on the employee's new office computer. He had used an engineering tool to fabricate documents to look like the printout of an email. The presentation of this evidence was the turning point in the case, which was summarily dismissed.
Recent Changes to the Rules of Civil Procedure
Both law makers and policymakers at the national level recognize the involvement of digital devices in modern-day litigation. Recent changes to the Federal Rules of Civil Procedure indicate that the court system is recognizing the crucial importance of electronic information in the process of investigation and litigation. While the Federal Rules of Civil Procedure have changed the production of electronic information, most decisions related to its evidentiary value are defined under the Federal Rules of Evidence. These rules apply to both civil and criminal proceedings, but most challenges and decisions related to digital evidence have been made in criminal courts.
In particular, the new rules indicate that digital documents are given the same weight and status as paper documents in terms of production. These rule changes underscore the fundamental shift of modern litigation toward the inclusion of electronic information in the legal process. Although the implications of these rule changes will not be clear until they are tested in the courts, it is expected that demand will increase for properly performed data collection and digital forensics investigations. As always, the admission of digital forensics evidence into cases will continue to be governed by the Daubert rules.
Licensing Requirements
Licensing requirements for forensic examiners have yet to be standardized on a national level, but most states require some level of certification to handle evidence and perform investigations. In the majority of states, digital forensics professionals are required to obtain a private investigator license; however, three states (Alabama, Alaska, and Wyoming) have licensing requirements only in certain cities, and others (Colorado, Idaho, and South Dakota) have no licensing requirements whatsoever. Given that this is a relatively recently established field, it is likely that a national certification for digital forensics examiners is on the horizon, particularly with Federal Rule changes that all but mandate the use of such experts to handle digital information.

Most licensing organizations impose both penalties and fines if examiners do not follow the proper evidentiary handling rules. The specific injunctions vary by state but typically include both financial sanctions and the revocation of licenses. It is important to investigate the certifications required by your state when seeking a digital forensics examiner. Knowingly hiring an unlicensed person can be punished through sanctions, fines, or worse: inadmissible evidence.
As digital devices become more pervasive in the modern world, the amount of electronic information processed into the legal landscape will continue to increase. Although many attorneys and investigators have yet to use the services of digital forensics experts, digital information can assist in almost any case. The complexity of such devices and the changeable nature of such information necessitates the establishment of digital forensics examiners as a crucial addition to the forensics field.

Experts are able to investigate user activity through such applications as email, instant messaging, text messaging, and even Internet telephone conversations. Gavin W. Manes, PhD, brings extensive knowledge in the field of digital forensics to his position of president of Oklahoma Digital Forensics Professionals Inc. Manes received his doctorate in computer science from the University of Tulsa (TU), where he now works as a research assistant professor. Since 1996, Manes has specialized in the fields of information assurance, computer security, and digital forensics at the Center for Information Security at TU. He has also published papers and journal articles and delivered congressional testimony in the areas of information assurance, digital forensics and telecommunications security.
Manes has briefed the White House National Security Council, and the Pentagon. For the last 2 years, he has given presentations on digital forensics at the ACFEI National Conference. In addition, he has all five National Information Assurance Education and Training Program federal information assurance certifications from the Committee on National Security Systems and the National Security Telecommunications and Information Systems Security Instruction.
